MICRO-LENDING TERMS & CONDITIONS (SOUTH AFRICA)

1. Loan Agreement
By submitting this application, I confirm that all information provided is true and correct and that I am applying for a loan subject to approval.

2. Loan Amount & Payment
The approved loan amount will be paid by EFT method. The Repayment date and amount is confirmed in this application and is non-negotiable.

3. Interest & Fees
I agree to pay the interest, fees, and charges as disclosed in the loan agreement. Interest and fees are calculated as agreed and in accordance with applicable South African law.

4. Repayment
Repayments must be made on or before the due dates without deduction. If a payment date falls on a non-business day, payment is due on the next business day.

5. Late Payment & Default
If I fail to pay on time or breach this agreement, the full outstanding balance may become immediately due, and legal and collection costs may be charged as permitted by law.

6. Section 129 Notice (National Credit Act)
Upon default, Cash Cartel will issue a notice in terms of Section 129(1)(a) of the NCA 34 of 2005, granting 10 business days to: arrange repayment; apply for debt review; refer to an ADR agent; or dispute the amount. Failure to respond entitles Cash Cartel to proceed with legal enforcement without further notice.

7. National Credit Act
Where applicable, this loan is subject to the National Credit Act 34 of 2005.

8. Authority & Consent
I confirm that I have legal capacity to contract and consent to credit checks, verification of information, and lawful sharing of my data for credit and compliance purposes. I consent to the capture of my location data for fraud prevention purposes.

9. Governing Law & Jurisdiction
This agreement is governed by the laws of the Republic of South Africa. I consent to the jurisdiction of the Stellenbosch Magistrates Court, Stellenbosch 7600.

10. Domicilium Citandi et Executandi
The Applicant chooses as their domicilium citandi et executandi the residential address provided above. The Lender's domicilium is: Cash Cartel (Pty) Ltd, 10 Church Street, Stellenbosch 7600. All legal proceedings shall be instituted in the Stellenbosch Magistrates Court.

⚖️ Statutory Legal Consents — Magistrates' Courts Act 32 of 1944
⚠ IMPORTANT — Please read carefully before initialling.
The three clauses below are legally binding consents. By initialling and agreeing you authorise Cash Cartel (Pty) Ltd to pursue these remedies upon non-payment.
CLAUSE A — CONSENT TO JUDGMENT — Section 57, Magistrates' Courts Act 32 of 1944
I hereby irrevocably and unconditionally consent to judgment being entered against me in the Magistrate's Court having jurisdiction, for: (a) The full outstanding principal amount owed; (b) Interest at the agreed rate to the date of payment; (c) All collection costs on the attorney-and-client scale; and (d) Any other charges permissible under the National Credit Act. Such judgment may be applied for ex parte (without me appearing or being re-served), upon filing of the signed Credit Agreement and a certificate of outstanding balance. I waive any right to prior notice of such application.

CLAUSE B — CONSENT TO GARNISHEE ORDER — Section 58, Magistrates' Courts Act 32 of 1944
I hereby consent to an Emoluments Attachment Order ("Garnishee Order") being issued against my current or any future employer upon default, authorising my employer to deduct the outstanding balance from my salary and pay same directly to Cash Cartel (Pty) Ltd. I acknowledge that: (a) This consent is given freely and voluntarily; (b) Cash Cartel will apply to the Magistrate's Court to confirm this Order; (c) The Court will ensure deductions do not prevent me meeting basic living expenses; (d) I must notify Cash Cartel immediately of any change of employer; and (e) My employer is legally obliged to comply once the Order is issued.
Note: Your employer details captured in this application will be used in the event a Garnishee Order is issued.

CLAUSE C — DOMICILIUM EXECUTANDI — Stellenbosch Magistrates Court
I hereby consent to and confirm that: (a) I choose as my Domicilium Citandi et Executandi (address for service of all legal process) the residential address provided in this application; (b) I irrevocably consent to the jurisdiction of the Stellenbosch Magistrates Court, Stellenbosch 7600 for all legal proceedings arising from or related to this credit agreement, including applications for judgment, Emoluments Attachment Orders, and enforcement proceedings; (c) I waive any right to object to the jurisdiction of the said court; and (d) Service of any legal process at my domicilium address shall be deemed valid and effective notice to me.
